Service to Business

The Challenges

Employment and Health and Safety legislation affects most businesses. Failure to make adequate provision can have serious consequences for employers. These may include:

  • An inability to obtain employers liability insurance, or an onerous premium
  • The need to defend proceedings instituted via the employment tribunals and the court.
  • Fines for breaches of regulations resulting in unexpected costs and bad publicity.
  • Low staff morale and poor productivity arising from a failure to address these issues.

Employers react in different ways to these problems.

Commercial legal expense insurance can be the answer but only for cases with a better than 50% chance of success.

The setting up of a human resources department can assist, but some companies do not have the time or funding for this. If a department is set up, it is frequently staffed by employees who do not have the necessary expertise and objectivity to deal with claims.

There is no easy answer, but doing nothing exposes your business to long-term problems.
